The agreement for using this site
These Terms of Service ("Terms") govern your access to and use of the American Capital Edge website at americancapitaledge.com (the "Site"), our direct-mail communications, our SMS messaging service, and any related offers, forms, and tools we provide (together, the "Services"). By using the Services or submitting any form, you agree to these Terms.
1. Who we are
American Capital Edge is a real estate investment firm ("we," "us," "our") that acquires property as a principal with its own capital. We acquire raw and improved parcels of land directly from owners and resell them to retail buyers, sometimes on installment terms. We do not solicit, accept, pool, or manage outside investor funds. Nothing on the Site constitutes an offer to sell securities or to lend; offers are made in writing only at the point of an executable transaction.
2. SMS messaging terms
The Services include SMS communications with property owners and inquirers who have opted in. The following terms apply to anyone who has opted in to SMS:
2.1 Opt-in
You opt in by either (a) checking the SMS consent box on the seller form at americancapitaledge.com, or (b) submitting the consent form linked from a personalized URL printed on a letter we mailed to you. By opting in you agree to receive SMS messages from American Capital Edge at the phone number you provided, regarding the property identified during opt-in.
2.2 Frequency
We expect to send no more than 1–3 messages per recipient over any 14-day period. Frequency may vary based on the conversation. We will not send promotional blasts or marketing unrelated to your property.
2.3 Costs
Standard message and data rates may apply, depending on your wireless carrier and plan. We do not charge separately for SMS.
2.4 Opt-out
You may opt out at any time by replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any message we send. We will confirm receipt and will not text the number again. You may also email us at team@americancapitaledge.com to be removed.
2.5 Help
Reply HELP or INFO to any message for assistance. You may also email us. We will respond with our company name, contact information, and a reference to the postcard or letter you received.
2.6 No reliance
SMS messages are informational only and do not constitute an offer to purchase, lend, or transact. Any binding offer is made in a written purchase agreement signed by both parties.
3. Use of the Site
You may use the Site for lawful purposes only. You agree not to (a) reverse-engineer, scrape at scale, or interfere with the Site's normal operation, (b) submit false or misleading information through any form, (c) impersonate another person, or (d) attempt to bypass any security or access control mechanism.
4. Property information & offers
Information about parcels, comparables, and pricing is sourced from public records and third-party data providers and is provided for general informational purposes only. We make no representation that any specific parcel is available for purchase, that any offer will close, or that any value estimate reflects current market conditions. Installment terms, when offered, are disclosed in writing only at the point of sale to confirmed buyers and are not advertised through SMS or the Site.

Our handling of personal information is described in our Privacy Policy, which is incorporated by reference into these Terms.
6. Disclaimers
THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OF THE SITE OR DELIVERY OF ANY SMS MESSAGE.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AMERICAN CAPITAL EDGE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR SERVICES IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100).
8. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising under or relating to these Terms shall be resolved in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.
9. Changes to these Terms
We may update these Terms. The "Last updated" date at the top reflects the most recent revision. Material changes will be highlighted on this page for 30 days. Continued use of the Site or Services after a change constitutes acceptance of the revised Terms.
